1. Acceptance of Terms

By accessing or using the Denoised platform ("Service"), you agree to these Terms of Use. If you do not agree with any part of these terms, do not use the Service. Use of the Service is restricted to individuals aged 18 or older.

2. Description of Service

Denoised is an AI-powered image generation and editing platform. The Service allows you to create, recreate, edit, and enhance images through AI models, using a credit-based system.

3. Account Registration

To use the Service, you must create an account with accurate and up-to-date information. By registering, you confirm that you are 18 years of age or older. You are responsible for the security of your account and all activities performed under it. Notify us immediately of any unauthorized use.

4. Plans and Payments

The Service offers free and paid plans with different monthly credit limits. Payments are processed by Stripe. Subscriptions renew automatically and can be canceled at any time from the Dashboard. Extra credits purchased individually are non-refundable. Unused monthly credits do not carry over to the next cycle.

5. Acceptable Use

You agree NOT to use the Service to:

• Generate illegal, defamatory, obscene content or content that violates third-party rights
• Create images that exploit, abuse, or endanger minors
• Generate deepfakes or misleading content intended for fraud
• Produce material that incites violence, hatred, or discrimination
• Violate copyrights, trademarks, or intellectual property of third parties
• Attempt to bypass technical limits, rate limits, or security mechanisms
• Resell access to the Service without authorization

6. Use of Artificial Intelligence and Transparency

The Service uses third-party AI models to process your requests. By using the Service:

• Your prompts and images are sent to AI providers solely to generate the requested output
• Denoised applies proprietary prompt enrichment processing to optimize image quality
• Your data is not used to train, fine-tune, or improve AI models
• AI-generated results may contain inaccuracies, artifacts, or unexpected content
• You are responsible for reviewing and validating generated content before using it

7. Intellectual Property

Images generated by you through the Service are your property for commercial and personal use, subject to limitations of the AI APIs used. The Denoised platform, including its interface, code, brand, design, and prompt enrichment technology, are exclusive property of Denoised. Denoised reserves the right to display generated images in the platform's public Exhibition, always in anonymized form.

8. Limitation of Liability

The Service is provided "as is." We do not guarantee that generated images will meet specific requirements, be error-free, or be available without interruption. AI generation may produce unexpected results. In no event shall Denoised be liable for indirect, incidental, or consequential damages arising from the use of the Service.

9. Content Moderation

We use automatic safety filters to prevent generation of inappropriate content. We reserve the right to suspend or terminate accounts that repeatedly violate acceptable use policies, without credit refund.

10. Cancellation and Termination

You may cancel your subscription at any time. Access to paid features remains until the end of the current billing cycle. We may suspend or terminate your account for violation of these Terms, with notice. You may request deletion of your account and data at any time.

11. Changes to Terms

We may update these Terms periodically. Significant changes will be communicated by email or platform notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil, including the General Data Protection Law (Law 13,709/2018). Any dispute shall be resolved in the jurisdiction of Porto Alegre/RS.
